This document sets out the terms and conditions between Ukrainian Information Technologies LLC d/b/a SoftServe (hereunder referred to as “SoftServe”), a company registered in Ukraine, having its registered office at Lviv region, Lviv, 79017,Vodohinna, 2 street, and you when you use this website and/or register for any event or conference organized by SoftServe (the “Event”). By using this website and/or registering for an Event you are agreeing to comply with and be bound by these terms and conditions. You should read this document carefully.
SoftServe will use its reasonable, good faith efforts to organize the Event for you. SoftServe has the right to alter or vary the program for the Event or to reschedule or cancel all or part of the Event. In the event of cancellation or rescheduling, SoftServe shall not be liable for any losses you suffer as a result of the cancellation or rescheduling, including but not limited to, ticket price, accommodation costs or travel expenses. SoftServe reserves the right to change the venue at its discretion. In the event of any changes, we will send an email to you or otherwise will contact will you, giving at least forty-eight (24) hours’ notice of such changes.
You shall comply with all reasonable safety and other announcements and/or directions whilst attending the Event. SoftServe has the right to refuse entry to the Event to any person without reason or to require them to cease participating in any activity. If you are found to be behaving in a manner deemed unsociable or potentially dangerous, in breach of these Terms and Conditions or any instructions or directions given to you by any official at the Event, you will be ejected from the Event.
SoftServe has no responsibility for lost or stolen property. The following articles are not permitted within the Event venue – illegal substances, weapons, dangerous or hazardous items, offensive materials, petrol generators and such other items as SoftServe may deem to be prohibited from time to time. Any person found in possession of such items may be refused entry into, or ejected from the Event venue.
Attending the Event and purchasing of the tickets is available only to individuals who are at least eighteen (18) years old. You represent and warrant not to be under the age of eighteen (18) years.
In the event of any accident you hereby agree to hold harmless and keep indemnified SoftServe, its staff, officials, representatives, agents, sub-contractors and members, each and every one of them from and against all actions, costs, expenses, claims and demands in respect of injury, fatal or otherwise, loss or damage, to person or property of yourself or any guests accompanying you, however caused or arising out of in connection with your participation in the Event.
The parties agree to negotiate in good faith to resolve any dispute between them. If the negotiations do not resolve the dispute to the reasonable satisfaction of all parties, then the parties agree that they shall consider dispute resolution alternatives other than litigation. If an alternative method of dispute resolution is not agreed any party may begin litigation proceedings.
If any provision of these terms and conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provisions and remainder of the agreement valid or enforceable.
SoftServe makes no warranties of any kind, whether express or implied, in relation to Event, including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, condition or completeness, or any implied warranty arising from course of dealing or usage or trade.
In no event will SoftServe be liable for any direct, indirect, special or other consequential damages for any use of this website, or on any other hyper linked website, including, without limitation, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if we are expressly advised of the possibility of such damages.
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within the website shall remain at all times owned by us or our licensors. We reserve all rights not expressly granted in and to the website and the content on the website.
SoftServe reserves the right to alter or amend these Terms and Conditions without prior notification and you will abide by such amended Terms and Conditions.
